Categories of Property Damage in Minnesota

Property Damage crimes in Minnesota are divided into four categories depending whether it involved the risk of bodily harm, whether the damage decreased the value of the property, whether the property belonged to a common carrier and the damage impaired service to the public, and whether there was a racial, religious or sexual bias motivating the actions of the alleged violator.

  • Criminal Damage to Property in the First Degree is property damage in which:
    • There was a reasonable foreseeable risk of bodily harm;
    • The property belonged to a common carrier;
    • The damage reduced the value of the property by $1,000; or
    • The damage reduced the value of the property by $500 and the violator had a prior conviction within the preceding three years.

It is a felony with a maximum sentence of 5 years in prison and/or a $10,000 fine;

  • Criminal Damage to Property in the Second Degree is property damage that reduced the value of the property by an amount between $500 and $1,000 and was motivated by racial, religious or sexual bias. It is a felony with a maximum sentence of one year plus one day in prison and/or a $3,000 fine.
  • Criminal Damage to Property in the Third Degree is property damage in which:
    • The damage reduced the value of the property by an amount between $500 and $1,000; or
    • The damage reduced the value of the property by not more than $500 and was motivated by racial, religious or sexual bias;

It is a gross misdemeanor level crime with a maximum sentence of one year in jail and/or a $3,000 fine.

  • Criminal Damage to Property in the Fourth Degree is a misdemeanor level crime that includes all intentional damage that is not First, Second or Third Degree Criminal Damage to Property.
